(3) Sharing of the username and password shall lead to deactivation of the membership in the following condition: (3A) If there is an attempt to simultaneously connect on the same username and password from two different computers. Such details are monitored from IP address. (3B) If it is brought to our notice that the users are sharing there passwords with other persons who are not registered users. (4) Reactivation of the account disabled due to conditions noted in (3) above shall be done after payment of 100% of the prevalent registration/subscription fees for unregistered members. This however, does not automatically mean that such accounts shall be reactivated. This shall be at the sole discretion of of the Company, its authorized representatives or employees. No claims of any nature shall be entertained for non renewal of membership account lapsed by way of clause 3 above. (5) The members shall be notified two weeks in advance regarding their renewal of membership. Failure to pay the renewal charges within 7 days of last date shall imply that the user is not interested in renewal of the account and the account shall automatically be deleted at the end of the expiry period. It is however, the responsibility of the user to get their account renewed even if there is no intimation from our side. (6) User acknowledges and agrees that Company, Partner, and their third party service providers do not endorse the content of any User communications and the contents of this service and are not responsible or liable for any unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, tortious, or otherwise objectionable content. (7) User agrees (a) not to use the Services for illegal purposes; (b) not to interfere with or disrupt the Services or servers or networks connected to the Services; (c) to comply with all requirements, procedures, policies and regulations of networks connected to the Services; (d) not to resell the Services or use of or access to the Services. (8) User agrees to indemnify and hold Company, Partner, and their third party service providers, and their parents, subsidiaries, affiliates, officers, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of the Services, User's connection to the Services, User's violation of the End-User Agreement, or User's violation of any rights of another. (9) User acknowledges and agrees that content, including but not limited to text, software, music, sound, photographs, graphics, video, or other material contained in sponsor advertisements or information presented to User through the Services or advertisers is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. User acknowledges and agrees that User is permitted to use this material and information only as expressly authorized by Company, Partner or advertisers, as applicable, and may not copy, reproduce, transmit, distribute, or create derivative works of such content or information without express authorization. The user is authorized to take printout solely for the purpose of meeting the daily professional requirements and not to transfer the same to any individual, corporate body or institution. The same shall be verified by official records before making any official submission in courts of law. (10) COMPANY, PARTNER, AND THEIR THIRD PARTY SERVICE PROVIDERS MAKE NO WARRANTY THAT THE SERVICES WILL MEET USER'S REQUIREMENTS, THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES COMPANY OR ITS THIRD PARTY SERVICE PROVIDERS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICES OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. Typographical errors shall be corrected as and when reported to us or detected by us. (11) USER UNDERSTANDS AND AGREES THAT ANY INFORMATION, CONTENT, DATA OR OTHER MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF OR FROM THE SERVICES IS DONE AT USER'S OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO USER'S COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DATA. (12) The membership is non transferable. It can however, as a special case be transferred to anybody within the family who are registered advocates. Any claims for non availability of information due to the above shall not be entertained. (17) The members are free to discontinue their membership at any instant and there shall be no financial claims whatsoever with regard to anything. (19) The links to other relevant information sites of the world has been provided for the purpose of bringing the wealth of information to desktop. However, we are in no way responsible for proper functioning of their respective sites because we are not the owners of those sites. Any such site which shall become redundant or problematic shall be removed from our Database of links. All such links are governed by the Linking Disclaimer Policy listed in the Legal Disclaimer Section. (20) Any revision in the annual renewal charges shall not be litigated by the users. Such increase shall only be to take care of the inflation and the increase in the manpower costs and any other such statutory levies which may be imposed by the Government of India and/or Government Of Madhya Pradesh for portal / content providers. We shall make all necessary efforts to keep the same non inflationary as far as possible to the best of our capabilities. (21) The site is proposed to be free from commercial advertisements because the advertisements increase the file opening/downloading time. Moreover, the judgments pages cannot carry any advertisements keeping in mind that the users shall be requiring to take printouts. The advertisement may only come (if at all) on the non judgements page in case the cost of operations go up and we would like to curtail on the revision of subscription/ renewal charges. (22) Company shall endeavour to be 24 hours online for attending to any needs of the members. The Online Chat With Representatives has already been installed. (23) Any missed judgments if brought to our notice by any member shall be taken up for building up to the site by us. This shall however not cover any unpublished judgments, unreportable judgements. (24) All The noted terms and conditions are subject to jurisdiction of courts at Indore. They can be ammended, altered and or clauses added or deleted in order to safeguard the contents and avoid the misuse / abuse of any kind of this Portal. (25) The information being provided cannot be the cause of any claims by the subscriber direct or implied due to any reasons whatsoever. No Directors / Employees/ Representatives/ Agents or Group Companies under the same management are in any way liable for any claims by the Registered User of This Portal. (27) USER FURTHER AGREES THAT COMPANY, PARTNER, AND THEIR THIRD PARTY SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM INTERRUPTION, SUSPENSION OR TERMINATION OF SERVICES, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHETHER SUCH INTERRUPTION, SUSPENSION OR TERMINATION WAS JUSTIFIED OR NOT, NEGLIGENT OR INTENTIONAL, INADVERTENT OR ADVERTENT.
